The total effective sentence for a prolonged, systematic scheme of providing unregistered migration assistance involving at least $227,655 in fees, multiple victims, forged documents, and significant victim impact was reduced from 6 years 6 months to 4 years 9 months on totality grounds. There remains a dearth of appellate authority on sentencing for migration agent offences under s 281(1) of the Migration Act, and no discernible sentencing range can be identified from existing cases. A trial judge's direction to a jury about the limitations of interpreted evidence, including rhetorical questions about the accuracy of interpretation, does not constitute a misdirection inviting speculation where the direction as a whole conveys that the jury should bear those limitations in mind when assessing credibility.
