The word 'procures' in s 321(5) of the Criminal Code (WA) bears its ordinary English meaning of 'to effect, cause or bring about' and does not require proof of abuse or a power imbalance between the offender and the child. The offence applies to juvenile offenders as well as adults. Factors such as age disparity, abuse, and power imbalance are relevant to sentencing, not to the elements of the offence. A single request that causes the child to perform the indecent act is sufficient to constitute procuring.
