The word 'proceedings' in s 9AA(3) of the Sentencing Act 1995 (WA) refers to the whole of the proceedings from the original charge, not merely to proceedings relating to a retrial following a successful appeal against conviction. A successful appeal does not 'wipe the slate clean' for the purposes of assessing the timing of a guilty plea. Where an offender had the opportunity to plead guilty to an alternative offence at an earlier stage but did not do so, that is a relevant factor in assessing the discount, even if the offender was convicted of a more serious offence in the interim.
