The jurisdiction of the Magistrates Court to hear a charge of contravening a family violence order under s 43 of the Family Violence Act 2016 (ACT) is determined by what is alleged in the information, not by whether the elements of the offence can ultimately be proved. The existence of an operative family violence order is an element of the offence to be adjudicated, not a jurisdictional prerequisite. A Special Interim Family Violence Order ends only by operation of s 30 of the FV Act, and a magistrate's inclusion of a temporal limitation on the order's conditions does not end the order itself. Detention on remand following a fair hearing with legal representation and reasons is not 'arbitrary' under s 18(1) of the Human Rights Act 2004 (ACT) merely because the charge is ultimately dismissed due to a defect not identified at the time of remand.
