The Court found that while the AAT erred by failing to evaluate representations about the applicant's lack of intent to target women and absence of premeditation when assessing the seriousness of his violent offending under Direction 99, this error was not material given the AAT's other findings about the applicant's extensive criminal history and risk to the community. The Court also rejected challenges to the AAT's findings about language barriers and impediments on return to Ethiopia.
