The Federal Court held that the Fair Work Commission has jurisdiction to arbitrate the entire dispute between an academic and university concerning alleged breaches of procedural requirements in a plagiarism investigation, including the power to consider the merits of plagiarism allegations as a step towards making remedial orders. The Court rejected the university's argument that the enterprise agreement impliedly reserved plagiarism determinations exclusively to the university's internal processes. While the FWC cannot substitute its view for the university's in the operation of the agreement, it may make findings about plagiarism as part of remediating consequences of procedural breaches.
