Under the ALR Act, Aboriginal land claims must now consider whether the Crown is deriving any use from its estate or interest in the land (including by leasing it), not merely whether there is physical use of the land by a tenant or occupier. Land subject to a Crown lease may not be claimable Crown land even if the tenant is not physically using the land.
