A tribunal of fact may infer from the naivety and detail of a child complainant's description of sexual acts that the child witnessed those acts in the context of the charged offending, using common sense and life experience, without breaching s 293 of the Criminal Procedure Act 1986 (NSW), but may not act on generalisations about what a child of a particular age would know about sexual matters.
