A trial judge should not anticipate how a complainant would answer further questions as a basis for refusing leave under s 306D of the Criminal Procedure Act 1986 (NSW), and a direction to the jury to scrutinise defence submissions about a complainant's dishonesty on the basis that matters were not put to the complainant may occasion a miscarriage of justice where the trial judge refused the very application to put those matters.
