Where success on appeal is mixed but one party substantially succeeded on the dominant issue, a broad brush apportionment of costs (here 90%) is appropriate rather than either the usual costs-follow-the-event order or each party bearing its own costs. Costs of a preliminary liability trial may be deferred pending the outcome of a damages assessment where a pre-trial settlement offer exists, as the overall measure of success cannot be determined until the final outcome is known.
