Under the Construction Contracts (Security of Payments) Act 2004 (NT), an adjudicator's failure to specify a date for payment does not invalidate a determination on the merits and may be corrected under the slip rule in s 43(2). However, an adjudicator who misconstrues s 10 of the Act as rendering contractual preconditions for payment claims of no effect commits jurisdictional error, because the definition of 'payment claim' in s 7A incorporates compliance with contractual requirements by defining it as a claim made 'under' the construction contract. The question whether the existence of a valid payment claim is a jurisdictional fact requiring objective establishment on judicial review was left open.
