Section 565 of the Industrial Relations Act 2016 (Qld) does not permit leave to appeal on grounds beyond error of law or jurisdictional error where the appeal is from the Industrial Court under s 554(1); s 565 only applies to appeals under s 554(2) from the full bench. The appeal period under s 564(3)(a) commences on the date of oral announcement of the decision at the hearing, not the date of subsequent written publication of reasons. Where a respondent contends an appeal had no prospects of success while briefing senior counsel in addition to junior counsel, the indemnity costs order may be limited to exclude senior counsel's costs.
