The aggregation of individually marginal instances of inappropriate prosecutorial conduct — including denigrating defence counsel's arguments, mocking the accused's evidence, commenting on the jury's gullibility, and making submissions on matters not put to the accused in cross-examination — may collectively constitute a miscarriage of justice even where individual instances might not.
