While the modern De Silva formulation is preferred in Queensland criminal practice, use of the older benchbook formulation and inclusion of reference to 'all the evidence' in the second limb of a Liberato direction will not necessarily constitute a misdirection when the summing-up as a whole adequately conveys the correct approach to onus of proof.
