While the right of appeal under s 668D remains exhausted after a first appeal dismissed on the merits, the Criminal Code and Other Legislation (Double Jeopardy Exception and Subsequent Appeals) Amendment Act 2024, once proclaimed, will confer jurisdiction for second appeals in particular circumstances.
