For charges of dangerous driving causing death or serious injury under ss 319(1) and 319(1A) of the Crimes Act 1958 (Vic), an indictment that specifies the date, place, type of driving (manner dangerous as opposed to dangerous speed), and the name of the alleged victim complies with cl 1(b) of sch 1 to the CPA. The specific acts or omissions constituting the manner of dangerous driving need not be particularised in the charge itself but are properly matters for the summary of prosecution opening under s 182(2) of the CPA. The principles in Fox v DPP (Vic) concerning the degree of particularity required in a charge-sheet apply equally to indictments filed under ch 5 of the CPA.
