Evidence of penetration in a sexual offence charge need not be given in express terms; it is sufficient if the evidence, read in context of the complainant's overall testimony (including evidence about related occasions and cross-examination), is capable of supporting a finding of penetration. A text message describing the accused as 'a rapist', read in context of surrounding communications identifying the accused and the complainant as a victim, is capable of constituting a complaint of rape.
