Dangerous driving causing death involving distraction by mobile phone use, including social media applications, falls within the category of aggravating factors for the offence, alongside excessive speed, erratic driving, fatigue and intoxication. The use of a mobile phone other than in hands-free mode is incompatible with safe vehicle operation, and any use of social media while driving is wholly unnecessary and to be deprecated. A sentence of 3 years and 4 months' imprisonment with a 2-year non-parole period was upheld for an offender of exemplary character who was distracted by Instagram for approximately 10 seconds while driving at 93 km/h.
