Where co-offenders of objectively similar moral culpability and personal circumstances receive widely disparate sentences for the same offence, and the sentencing judge fails to explain the basis for the disparity, the parity principle will be infringed. However, the appellate court is not required to reduce the sentence to match an extraordinarily lenient co-offender sentence; it may impose a sentence towards the bottom of the available range. The resentenced term for aggravated burglary in this case is of limited precedential value as it was driven by parity considerations.
