Intoxication at the time of breaching a family violence order does not reduce the objective seriousness of the offending. A sentencing court assessing objective seriousness is not required to place the offending on a quantitative range (low, mid, high) but must identify the particular features informing seriousness. Exchanges between the bench and counsel immediately before sentencing may supplement the Magistrate's formal reasons.
