The Federal Court made a consent determination of native title under s 87 of the Native Title Act 1993 (Cth) recognising the Payarri People's native title rights and interests over an area in the northern goldfields region of Western Australia. The determination recognised both exclusive native title rights (right to possession, occupation, use and enjoyment to the exclusion of all others) over unallocated Crown land and non-exclusive rights over the remainder of the determination area. The Court resolved an intra-Indigenous dispute regarding the right people for the claim area by recognising both descendants of the original Pini inhabitants and Western Desert people who migrated to the area from the 1920s onward and acquired rights through the 'long association' pathway under Western Desert traditional laws and customs.
