The Court upheld a Registrar's refusal under r 2.26 of the Federal Court Rules 2011 to accept documents for filing, finding no reviewable error where the originating application on its face failed to articulate how statutory preconditions for relief were met. The proceeding was permanently stayed as an abuse of process because it sought to resuscitate substantially the same arguments previously dismissed as untenable and permanently stayed by Murphy J in Kant v Principal Registrar [2025] FCA 274. The Court also noted that the CIA Director enjoys foreign state immunity under s 9 of the Foreign States Immunities Act 1985 and that the Privacy Act 1988 does not apply to foreign bodies politic, though these merits points were not necessary to the decision.
