The Federal Court held that foreign exchange gains are not 'costs, charges or expenses' within s 269TAB(2)(b) of the Customs Act for the purpose of calculating prescribed deductions from the deductive export price, as those words in their ordinary commercial meaning connote expenditure, burden or loss rather than revenue gains. However, the Court found that the Commissioner, Panel and Minister erred in law by using a single averaged exchange rate for each quarter of the investigation period when converting currencies under s 269TAF(1), which requires the rate of exchange on the date of the specific transaction or agreement that best establishes the material terms of sale. The Court rejected the respondents' argument that the weighted average comparison methodology under s 269TACB(2) permitted a corresponding averaging of exchange rates under s 269TAF(1), holding these are distinct statutory operations. The question of appropriate relief remains reserved for further hearing.
