The Minister may assess the merits and prospects of success of a pharmacist's request for Ministerial approval under s 90A of the National Health Act at the preliminary s 90B(4) filtering stage, and the provision of reasons under the ADJR Act does not convert the procedural decision into a substantive consideration triggering procedural fairness obligations.
