Extensions of patent term under s 70 of the Patents Act 1990 (Cth) are no longer available for formulations (mixtures of active ingredients and excipients) as 'pharmaceutical substances'. Only active pharmaceutical ingredients qualify, meaning extensions based on formulation patents rather than compound patents will not be available.
