In health practitioner disciplinary proceedings, a finding that a practitioner's objectivity was compromised by financial considerations must be properly particularised in the complaint; it cannot be raised for the first time in cross-examination or inferred from vague references in further particulars. The Tribunal must apply the statutory test for professional misconduct in s 139E of the National Law, not the Pillai v Messiter standard from a superseded statutory scheme.
