Where a review panel under the Motor Accident Injuries Act 2017 (NSW) identifies two independent bases for a causation finding, an error in one basis will not vitiate the decision if the other basis is rational and legally sound; however, where an alternative plausible cause of injury exists, the panel must evaluate that alternative before inferring causation from circumstances alone.
