A single Judge of Appeal under s 46 of the Supreme Court Act 1970 (NSW) can only make orders within the scope of the appeal commenced in the Court of Appeal; orders seeking relief unrelated to the subject matter of the appeal, including criminal findings and arrest warrants, fall outside that power.
