Where an adjudication determination under security of payment legislation is quashed for jurisdictional error, the resulting judgment may be set aside and there is a right to restitution of moneys paid under it with no general law discretion to withhold relief; s 38(3) of the SOP Act (ACT) does not provide an exclusive source of restitutionary power.
