The Tribunal found that a used 2015 Audi Q7 sold for $41,500 was not of acceptable quality under s 54 ACL, constituting a major failure under s 260(a), where the vehicle developed recurring oil and coolant leaks, premature control arm bushing failures, and transmission failure within 19 months and 33,702 km of supply, with repair costs exceeding the purchase price. The applicant was awarded a full refund of $41,500 plus damages of $7,348 (extended warranty, dealer origination fee, and replacement tyres) and costs of $597, but claims for loan interest were refused due to insufficient evidence of the actual interest incurred following early payout, and a claim for the applicant's time was refused following Cachia v Hanes.
