Section 84 of the Supreme Court Act 1979 (NT) permits interest only on 'the sum for which judgment is given' and does not authorise interest on amounts from which mitigation payments have been deducted before judgment. Where a plaintiff has received payments in mitigation before judgment and seeks compensation for being kept out of money during the period before those payments were received, the claim must be pleaded and proved as interest as damages under Hungerfords v Walker. The prima facie measure of damages under s 52(3) of the Sale of Goods Act 1972 (NT) does not apply where the buyer has accepted the goods within the meaning of s 38 before termination of the contract.
