A trial judge's finding that payments were unconditional gifts, based on accepted oral evidence and credibility assessments, will not be disturbed on appeal absent something pointing decisively to error; and a party who expressly confines their case at trial (e.g., conceding restitutionary claims fall away if gifts are found) cannot challenge that confinement on appeal.
