Defence practitioners should object to majority verdict directions where the trial judge has not first given a Black direction and allowed further deliberation time, particularly following mid-deliberation juror discharge under s 56; a jury note merely enquiring about majority verdict thresholds does not satisfy the s 59A(2) precondition that unanimity is unlikely, and failure to satisfy that precondition constitutes a miscarriage of justice warranting a new trial.
