The District Court allowed an appeal against a sentence of 28 days imprisonment wholly suspended for 12 months for breach of bail, finding that the magistrate erred by giving undue weight to irrelevant criminal history, failing to apply the imprisonment-as-last-resort principle, failing to account for the early guilty plea, and imposing a disproportionately long operational period, and substituted a conviction with no further punishment.
