The Homes Act 1935 (Tas) does not create a private right of action sounding in damages for breach of statutory duty. The statutory obligations under the Act operate for the benefit of the public at large, not a specified class of persons. Section 17 of the Homes Act is discretionary and does not mandate the Director to facilitate the sale of homes to individual tenants. An extension of time to appeal will be refused where the grounds of appeal are devoid of merit.
