An application for extension of bail under the Bail Act 1977 (Vic) is, in substance, a fresh application for bail, such that amendments to the Act apply to it under the transitional provisions. Under the Bail Amendment Act 2025 (Vic), community safety is now of 'overarching importance' rather than merely equal to the presumption of innocence, and remand of a child is no longer required to be treated as 'a last resort', though minimum intervention remains required.
