A delay of five years and eight months in commencing judicial review proceedings, where the applicant was aware of the relevant facts throughout, will not constitute special circumstances under r 56.02(3) even where the applicant asserts mental health difficulties, if the applicant has demonstrated capacity to conduct other legal proceedings during the period of delay.
