DPP v Ristic [2024] VSCA 251 does not establish a baseline or tariff that sentences of at least 3 years' imprisonment are usually warranted for all 'intent to steal', 'persons present' aggravated burglaries; it was confined to its own circumstances and each case must be assessed on its unique facts.
