The critical component that distinguishes a perseverance direction from other directions to a jury is the instruction to re-examine matters of disagreement and make a further attempt to reach a verdict; directions to consult, discuss differences, and weigh opinions do not of themselves constitute a perseverance direction prohibited by ss 64B and 64D of the Jury Directions Act 2015 when given alongside a majority verdict direction.
