Credit for time spent in residential rehabilitation on bail (under the Akoka principle) must form part of the instinctive synthesis and cannot be subjected to mathematical analysis; a prior conviction for the same offence type may rationally explain a reduced disparity between co-offenders' sentences despite one offender's superior rehabilitation.
