A director who gives instructions to file proceedings on behalf of a company, and lends money to the company to fund litigation, does not thereby play a sufficiently active role or hold a sufficient interest to be characterised as a 'real party' for the purposes of a non-party costs order under Knight v FP Special Assets Ltd, where those actions are no more than would be expected of any director complying with their obligations.
