A fisheries notice (or analogous delegated legislation) that exposes persons to criminal sanctions for conduct that is practically unavoidable — such as inadvertent bycatch where a zero catch limit is set for a species that will inevitably be caught — is not capable of being considered reasonably proportionate to a statutory objective of efficient and effective fisheries management.
