The traditional factors for assessing the objective gravity of rape identified in Jurj v The Queen may not be wholly applicable to 'stealthing' cases where the complainant consented to penetration of a different nature and character (with a condom), and the assessment of objective gravity in such cases warrants full appellate consideration.
