The offence of refusing to accompany a police officer to a testing vehicle under s 49(1)(eb) of the Road Safety Act 1986 cannot be established where the evidence, taken at its highest, shows the accused was already in very close proximity to the testing vehicle and the police officer's notes did not record the accused's location at the time of the requests.
