An application to adduce further evidence under r 64.13 should not be refused at the filing stage under r 64.43 unless it is plain on the face of the documents that they bear no relationship whatsoever to the issues raised by the application for leave to appeal; the question of relevance and likely impact is for substantive judicial determination.
