A trial judge who gives firm assurances that leave to reopen a case will be granted, as part of a compromise resolving a Browne v Dunn objection, cannot subsequently refuse that leave without explanation; and holding one party to its forensic choice while excusing the other party's forensic choice constitutes a denial of procedural fairness.
