Under s 27QE of the Limitation of Actions Act 1958 (Vic), a settlement agreement for historical child abuse may be set aside in whole even where the plaintiff did not pursue economic loss at the time of settlement, provided the overall settlement was at undervalue and the Ellis defence materially influenced the settlement process — the plaintiff need not prove the Ellis defence specifically influenced the decision not to claim economic loss.
