Where an accused kills in pursuit of an original criminal design to murder, the evidence will not suggest a reasonable possibility of self-defence under s 322I of the Crimes Act 1958 merely because the victim may have used unlawful force during the execution of that design; the focus must be on whether the accused's conduct was responsive to the victim's actions under s 322K, not merely on the lawfulness of the victim's conduct under s 322L.
