A trial judge assessing damages for loss of earning capacity may subsume a Malec discount within a vicissitudes discount (or vice versa) for different periods without error, provided the judge's overall evaluation accounts for the relevant contingencies, and the mere fact that different percentage discounts are applied to past and future periods does not indicate error where the risks are of different dimension in each period.
