When assessing whether disclosure of an internal working document would be contrary to the public interest under s 30(1)(b) of the FOI Act, a tribunal may properly distinguish between documents containing competing or evolving preliminary positions (which may inhibit future candour if disclosed) and documents containing a direct question and answer exchange (which are less likely to do so).
